W. Scott Bias, President, called the special meeting of the Cabell County Commission to order at 10:00 a.m.

 

#084                            DISCUSSION/ACTION REGARDING BILL OF EXCEPTIONS

                                    TO BE FILED IN THE CIRCUIT COURT OF CABELL

                                    COUNTY, WEST VIRGINIA, REGARDING TAX

                                    ASSESSMENT OF THE WOODLANDS RETIREMENT

                                    COMMUNITY   

 

William Watson, County Attorney, informed the Commission the Foster Foundation had filed a Bill of Exceptions regarding the assessed value of the Woodlands Retirement Community.  Mr. Watson stated that by state code, the Commission, acting as the Board of Equalization and Review, would need to sign the document to acknowledge submission of the Bill of Exceptions.  Mr. Watson further stated that by signing said document did not mean the Commission was in agreement with the Foster Foundation. 

 

Jerry Hutchinson, Reappraiser Chief Deputy Assessor, stated the suit, filed by the Foster Foundation, stated the Assessor’s Office did not have a licensed real estate appraiser, which was not the case, therefore, he did not believe the suit would be a problem.  Mr. Hutchinson went on to say the appraisers in the Assessor’s Office were certified by the state and probably had more hours in the field then a licensed appraiser.  Mr. Hutchinson stated that all fifty-five counties used appraisers certified by the state and if the Foster Foundation should win this suit it would affect the whole state.

 

Nancy Cartmill, Commissioner, stated the suit filed by Victory Place would also have ramifications state-wide because their suit stated that the Commission, sitting as the Board of Equalization and Review, benefited from the assessment of property, therefore, the Commission could possibly keep the rates higher. 

 

Robert L. Bailey, Commissioner, moved to sign the Bill of Exceptions submitted by the Foster Foundation regarding the Woodlands Retirement Community.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.  Exhibit (A)

#085                            APPROVAL OF THE FY 2007-2008 CABELL COUNTY

                                    GENERAL FUND AND COAL SEVERANCE LEVY

                                    ESTIMATE (BUDGET)

 

Stephen Zoeller, County Manager, stated he had made the changes the Commission voted on at the March 8, 2007 meeting.  Mr. Zoeller informed the Commission the only change he made was to increase the Sheriff’s budget to include salary adjustments, matching funds and benefits by $145,000.  Mr. Zoeller further stated that $290,692,000 of unencumbered funds was used to balance the 2007-2008 budget. 

 

Mr. Zoeller stated the total revenue was $16,258,227 and the expenditures were $16,258,227 for the General Fund and $206,000 for Coal Severance.

 

Robert L. Bailey, Commissioner, stated he was upset with some of the changes and wished the Sheriff would have reduced his security budget in order to provide the raises for the deputies.

 

Robert L. Bailey, Commissioner, moved to approve the 2007-2008 Cabell County General Fund and Coal Severance Fund Levy Estimate Budget.  Nancy Cartmill, Commissioner, seconded the motion and the vote was as follows:

W. Scott Bias, President, stated for the record he voted no because he believed the pay raises for the deputies should have come from the surplus instead of the jail per diem.  President Bias further stated he believed there would be enough new tax revenue to cover the raises. 

 

W. Scott Bias, President, adjourned the special meeting at 10:15 a.m., until the next scheduled meeting on Thursday, April 5, 2007, at 10:00 a.m.
