W. Scott Bias. President, called the regular scheduled meeting of the Cabell County Commission to order at 10:00 a.m.

 

APPROVE:

 

Nancy Cartmill, Commissioner, moved to approve the agenda as presented.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.

 

Robert L. Bailey, Commissioner, moved to approve purchase orders #2585 B through #2637 B and pay jackets.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

 

Nancy Cartmill, Commissioner, moved to approve erroneous assessments, land consolidations, split tickets and probate documentation.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.

 

Robert L. Bailey, Commissioner, moved to approve handwritten checks to Mountain State Blue Cross and Blue Shield, not to exceed $100,00.00, from the Cabell County Medical Insurance Fund and a handwritten check to Greg Edens, Cabell County 4-H Camp, P.O. #2639 B for $2,252.25.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

 

#339                            EXECUTION OF ORDER IN THE ESTATE OF

                                    CHARLES LABE BROWN 

 

William Watson, County Attorney, stated that at the last meeting the Commission held a hearing regarding the Estate of Charles Labe Brown.  Mr. Watson further stated that at the hearing the Commission denied the petition to removed Joseph Labe Brown as the Administrator of the Estate of Charles Labe Brown and ordered Mr. Brown to file an appraisement of the estate in sixty days.  Mr. Watson went on to say this was a reflection of that order.

 

Nancy Cartmill, Commissioner, moved to approve the execution of said order.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.

#340                            DISCUSSION OF BIDS:

 

                                    RE:  ONE (1) USED AMBULANCE TYPE I/III TWO REAL                                                   WHEEL (4X2) CRITICAL CARE TRANSPORT  

                                             AMBULANCE  

 

Gordon Merry, CCEMS Director, informed the Commission he had driven to Parkersburg and Morgantown to look at the vehicles in the proposed bids and both vehicles were unacceptable and he would recommend the bids be rejected.

 

Nancy Cartmill, Commissioner, moved to reject both bids on the used ambulances.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.

 

#341                            LETTER, MAUREEN BREEDLOVE, PRESIDENT

                                    HUNTINGTON GARDEN CLUB

 

                                    RE:  RESTORATION OF BY-WAY MARKER AT CITY HALL

                                             ON FIFTH AVENUE AND EIGHT STREET

 

William Watson, County Attorney, stated that the City of Huntington had removed the By-Way Marker, that honored the men and women who had served or were serving in the Armed Services, from City Hall property.  Mr. Watson further stated the marker was placed there by the Huntington Garden Club and now the club was requesting the marker be placed on Courthouse property, with the Garden Club providing the landscaping.   

 

Robert L. Bailey, Commissioner, moved to approve the Huntington Garden Club placing the By-Way Marker on Courthouse property.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous. 

 

#342                            LETTER, CARL MARCUM, WVU EXTENSION AGENT

 

                                    RE:  GOATS LOST BY DENNIS DUNKLE DUE TO

                                             STRAY DOGS

 

Stephen Zoeller, County Manager, stated a letter had been received from Carl Marcum, West Virginia University Agent, on behalf of Dennis Dunkle who had ten goats either killed or euthanized due to injuries by stray dogs.  Mr. Zoeller further stated that in the letter Mr. Marcum valued the cost  of each goat from $50.00 to $75.00.

 

Robert L. Bailey, Commissioner, moved to pay Mr. Dunkle $75.00 for each goat injured or killed at the end of the year and the amount would be pro-rated if there were other claims.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

#343                            RESOLUTION, CABELL COUNTY COMMISSION

 

                                    RE:  EMPLOYMENT – CCEMS 

 

Nancy Cartmill, Commissioner, moved to approve the employment of Daronda Marie Fletcher as a full-time Paramedic, effective November 17, 2006, with a rate of pay of $8.97 per hour.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.

 

#344                            RESOLUTION, CABELL COUTNY COMMISSION

 

                                    RE:  EMPLOYMENT RECLASSIFICATION – CCEMS 

 

 

Robert L. Bailey, Commissioner, moved to approve the employment of Trenten E. Damron and Brian K. Wellman as full-time EMTS, effective November 17, 2006, with a rate of pay of $6.82 per hour.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

 

#345                            LETTER, CABELL COUNTY COMMISSION

 

                                    RE:  ISSUANCE OF DUPLICATE CERTIFICATES FOR

                                             PROPERTY PURCHASED AT THE 2004 TAX SALE

                                             DAVID M. HOLBROOK 

 

 

Fred Hitchings, David Holbrook’s step-father, stated that Mr. Holbrook had lost his certificates during a move and Mr. Holbrook was requesting a duplicate certificate for the property purchased at the 2004 Tax Sale. 

 

Robert L. Bailey, Commissioner, moved to approve the issuance of a duplicate certificate for property purchased at the 2004 Tax Sale by David M. Holbrook.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

 

#346                            DISCUSSION/ACTION

 

                                    RE:  MODIFICATION, COURTHOUSE FACILITIES

                                             IMPROVEMENT GRANT 

 

Stephen Zoeller, County Manager, stated the grant the county received to work on the 7th Street side of the Courthouse was for $100.000.00 and only $83,000.00 was used for that project.  Mr. Zoeller further stated that he would like permission from the Commission to place out for bid renovation work for the front of the 4th Avenue side of the Courthouse, with the remaining funds from this grant.

Commissioner Cartmill asked if there was something in writing that would explain what would be modified.  Mr. Zoeller stated it would be replacing a couple of the steps, cleaning the whole area, re-caulking and alterations around the front door.  Commissioner Cartmill asked if this included an extra set of doors and Mr. Zoeller replied it did not. 

 

Nancy Cartmill, Commissioner, moved to approve placing bids out for renovation work for the 4th Avenue side of the Courthouse.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.

 

#347                            DISCUSSION/ACTION:

 

                                    RE:  FLOODPLAIN PERMIT COMPLIANCE

 

Stephen Zoeller, County Manager, informed the Commission that in a couple of weeks letters would be sent to residents in the county requesting that they come in and pay for a building permit because there seemed to be properties that did not have permits.

 

Mr. Zoeller also informed the Commission that when residents come into apply for a building permit they are asked the value of their property and sometimes the amount that was given was much less then the actual value.  Mr. Zoeller stated he believed setting a fee to a cost per foot, would serve the Commission better.  Mr. Zoeller recommended using $70.00 to $75.00 per square foot.

 

Commissioner Cartmill stated she had several concerns regarding the Floodplain Ordinance and believed the Ordinance should be reviewed.      

 

Mr. Zoeller stated that the Ordinance was only designed to addresses the floodplain.

 

Robert L. Bailey, Commissioner, moved to modify the Ordinance to establish the value of structures at $75.00 per square foot for the purpose of setting permit fee.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

 

#348                            RESOLUTION, GENERAL FUND, STATE BUDGET

                                    REVISION #6, FY 2006-2007 

 

Nancy Cartmill, Commissioner, moved to approve General Fund State Budget Revision #6.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.  Exhibit (A)

 

W. Scott Bias, President, adjourned the meeting at 10:35 a.m., until the next regular scheduled meeting Thursday, November 30, 2006, at 10:00 a.m.
