Kay Day, Assessor’s Chief Deputy, stated the Assessor’s Real, Personal and Business Property books were available for the board to review, if needed.

 Ms. Cremeans stated that the building on this property, at one time, had been leased to a church, however, the building was now empty.  Ms. Cremeans further stated that because there were restrictions in the deed and no proper right-of-way, the property was very hard to sell.

 

Jon Wheeler, Cabell County Assessor’s Office, stated the higher appraisal was due to the land sales in the area.

Ms. Toppings stated she did not agree with the appraised value of her property and gave the Board information on property around hers.  Ms. Toppings further stated she had measured her house and the square footage was not the same as the assessor’s records.  Mrs. Toppings went on to say that she had a handicap ramp added on to her house and informed the Commission she believed her high assessment was personal.

J. D. Adkins, Cabell County Assessor’s Office, informed the Board that the house next to Ms. Woolen’s sold for $73,400 and it was a one story house.  Mr. Adkins went on to say that as you go further down the block from Ms. Woolum’s house, the property value did go down.

Mr. Lunsford stated that the first piece of property was a gift from his parents and was only used for farming; the second piece of property had a block house with a concrete floor and the third piece of property was appraised for too much because the basement floods. 

 

Brent Williams, Cabell County Assessor’s Office, explained that the 91.4 acres and the one acre was really one piece of property, however, they had to separate the properties due to a different tax rate because the one acre had a house on it that was not being utilized for farming.  Mr. William went on to say that the 91.4 acres had an exemption because it was used for farming.  Mr. Williams also gave the Commission information on the sale of properties around Mr. Lunsford’s property and mentioned that other properties in the area had also been reappraised.

Robert L. Bailey, Commissioner, moved to approve lowering the appraised value of the property located at 5206 State Route 10, Salt Rock, McComas District, Map 14, Parcel 33 from $38,100 to $30,000.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

 

Robert L. Bailey, Commissioner, moved to approve lowering the appraised value of the property located at 10 Sunny Drive, Ona, Grant District, Map 12, Parcel 57.4, Class 2 (HE) from $201,900 to $165,000.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous. 

 

Robert L. Bailey, Commissioner, moved to approve lowering the appraised value of the property located at 303 West 10th Avenue, Huntington, Kyle District, Map 43, Parcel 499, Class 2 (HE) from $85,700 to $74,900.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

John Perry, Cabell County Assessor’s Office, explained that the West Virginia Property Division, Appraisal Services Unit, had completed a correction of fourteen industrial real estate parcels in Cabell County, that were found to be in error because of incorrect land table values.  Mr. Perry stated since this error was in part by the State Tax Department, all costs of mailing certified letters to the businesses would be paid by the Tax Department.

Everett Chapman, 1398 Dry Creek Road, stated he believed that the assessment of his property was too high because of the location of his property.  Mr. Chapman further stated that he had built the structure himself, the land had been given to him by his grandmother and his property flooded several times a year. 

 

Brent Williams, Cabell County Assessor’s Office, stated Mr. Chapman’s property was appraised at market value and with the sales comparable method.  Mr. Williams further stated that a house smaller than Mr. Chapman’s sold for $65,000, but the increase was due to the value of the land which increased with an average of $700.00 an acre.  Mr. Williams went on to say that Mr. Chapman did receive a reduction, in the amount of $7,500.00, in consideration of the flooding.

Mr. & Mrs. Ramsey stated they believed their appraisement was too high because they believed the house in which they were living should be torn down.

 

Brent Williams, Cabell County Assessor’s Office, showed the Board a map of where the property was located and stated that the land value in that area had also increased, making their property more valuable. Mr. Williams stated that the comparable replacement method was used in the assessment and a 20% reduction was also taken in consideration due to some of their land flooding.

Mr. Faherty explained to the Board that the Foster Foundation was created as a non-profit corporation.  Mr. Faherty went on to say that no state or federal funds were used to build the Woodlands Retirement Center.  Mr. Faherty stated that no resident was required to leave Woodlands for a lack of funds.

 

Commissioner Bailey asked if the residents lose their Homestead Exemption when they move to the Woodlands and Mr. Faherty replied they did.

 

Robert Withers, Certified Appraiser hired by the Foster Foundation, showed the Board what he believed to be comparable assessment and tax data on several properties that he believed to be comparable to Woodlands.

 

Mr. Withers explained to the Board what appraisers look for when they do appraisements and gave the Board a sheet with what he believed the appraisement should be for the Woodlands.

 

Brian Daniels, Cabell County Assessor’s Office, gave the Board pictures of the Woodland Retirement Center and the individual homes that have been built on the grounds.  Mr. Williams gave information to the Board on the cost of permits that have been issued for the expansion of Woodlands. 

 

Nancy Cartmill, Commissioner, asked Ottie Adkins, Assessor, if any of his employees were certified appraisers and Mr. Adkins replied they were not.  Mr. Adkins explained that his appraisers meet state requirements and also have on the job training.

Charles Peoples, Attorney, appeared before the Board on behalf of the Simms School Limited Partnership and the Huntington High Limited Partnership, requesting the appraised value be lowered for both properties.  Mr. Peoples stated that both properties’ rents were subsidized by the government which would not create a cash flow.  Mr. Peoples went on to say there were restrictions in the deeds of both properties. 

 

David Bunch, Certified Appraiser, stated that due to the deed restrictions and the negative cash flow he believed the properties had no market value and were non-saleable.

 

John Perry, Cabell County Assessor’s Office, stated he would speak with the State Tax Department regarding the correct way to appraise these properties for the year 2007 and the Assessor’s Office would be fine with whatever the Board should decide for 2006.

 

Robert L. Bailey, Commissioner, moved to lower the appraised value of the property for Simms School Limited Partnership, located at 1680 11th Avenue, Huntington, Gideon District, Map 46 and Parcel 48.1 from $513,900 to a zero amount and to lower the appraised value of the property for Huntington High Limited Partnership, located at 8th Street and 9th Avenue, Huntington, Gideon District, Map 44 and Parcel 222 from $2,922,500 to a zero amount.  W. William Frazier, Attorney for R. Lawrence Dunworth, appeared before the Board to request lowering the appraised value of property owned by Mr. Dunworth.  Mr. Frazier stated he believed the assessor failed to follow the statute (11-3-1) and had failed to apply the exception to the true and actual value in the appraisement of Mr. Dunworth’s property.

 

Jerry Hutchinson, Cabell County Assessor’s Office, passed out a letter to the Board from the Attorney General’s Office which stated the statute in question had been superseded by several other laws which would mean the old law was not applicable.  

 

Mr. Frazier stated he believed the statue had not been repealed, therefore, it was still valid. 

 

Commissioner Cartmill asked how the Assessor came to the appraised value. 

 

Jon Wheeler, Cabell County Assessor’s Office, stated the appraised value was from the cost of replacement which would be approximately $165.00 per square foot.

Nancy Cartmill, Commissioner, moved to approve leaving the appraised value of the property located at 3045 8th Street, Huntington, Guyandotte District, Map 6N and Parcel 8 at $1,818,200.  Robert L. Bailey, Commissioner, seconded the motion and the vote was unanimous.

President Bias stated the Board would revisit the issue of Simms School Limited Partnership and the Huntington High Limited Partnership properties.

 

Jerry Hutchinson, Reappraisal Chief Deputy, stated that when the Assessor’s Attorney checked into the deeds of both properties, he could not find any restrictions.  Mr. Hutchinson went on to say that he had talked with the State Tax Department on this issue and they believed that by placing a zero amount for the appraised value of the property, it would be setting a precedence which would not be in the best interest of the county. 

 

Brian Daniels, Cabell County Assessor’s Office, stated this property was not typically subsidized housing, as federal grants were used to renovate the property placing a forty year cap on the amount of rent to be charged and restricting the use of the property. Mr. Daniels went on to say that having this information now, he could adjust that appraised value from $513, 900 to $312,200.

 

Nancy Cartmill, Commissioner, moved to resend the previous motion on February 17, 2006, where the appraised value for the Simms property was reduced to a zero amount.  W. Scott Bias, President, seconded the motion and the vote was unanimous.

 

Nancy Cartmill, Commissioner, moved to reduce the Simms School Limited Partnership located at 1680 11th Avenue, Huntington, Gideon District, Map 46 and Parcel 45.1 from $513,900 to $312,200.  W. Scott Bias, President, seconded the motion and the vote was unanimous.

Brian Daniels, Cabell County Assessor’s Office, stated the same thing applied for the Huntington High Limited Partnership as it did for the Simms School Partnership and the Assessor’s Office could lower the appraised value to $2,000,000.

 

Nancy Cartmill, Commissioner, moved to resend the previous motion made on February 17, 2006, where the appraised value of the Huntington High property was reduced to a zero amount.  W. Scott Bias, President, seconded the motion and the vote was unanimous.

 

Nancy Cartmill, Commissioner, moved to reduce the Huntington High Limited Partnership, located at 8th Street and 9th Avenue, Huntington, Gideon District, Map 44 and Parcel 222 from $2,922,500 to $2,000,000.  W. Scott Bias, President, seconded the motion and the vote was unanimous.
