Robert L. Bailey, President, called the Special Meeting of the Cabell County Commission to order at 1:00 p.m.

RE: ESTABLISHMENT OF MENTAL HYGIENE HEARINGS
Glenn White, County Manager, stated that a Supreme Court order had been issued, regarding mental hygiene hearings. Mr. White further stated that Paul Biser was representing the Mental Hygiene Commissioners.
Mr. Biser stated that the Supreme Court issued an order stating that the state facilities would no longer accept mental hygiene persons without a Probable Cause Hearing and this would go into effect Monday, June 27, 2005.
Mr. Biser stated that he and several people had discussed using a room in the old jail to hold the mental hygiene persons and that the deputies, who were already watching inmates from the Regional Jail, could monitor the patients. Mr. Biser went on to say that Prestera Center would then come to the holding room to do the certification and then the Mental Hygiene Commissioner would come to the holding room to conduct a Probable Cause Hearing so the patient could then be transported to the Mildred Bateman Hospital.
Glenn White, County Manager, stated he had looked at the rooms and he believed there could be a liability issue by using the rooms in the old jail to hold the mental hygiene patients and further the rooms could not be ready to use by Monday.
Ancel Ramey, Attorney, stated that on a procedural matter, Cabell County was a respondent and the opinion was issued May 27, 2005, which means it does not become official until Monday, June 27, 2005. Mr. Ramey further stated if the Commission filed a petition by Monday, it would suspend the mandate of the court and it was unlikely the court would take the petition up until it returned for the September session, which would give the Commission some time to come up with a solution.
W. Scott Bias, Commissioner, moved to file a petition by Monday, June 27, 2005 for a re-hearing on this matter. Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

Nancy Cartmill, Commissioner, asked Chris Chiles, Prosecuting Attorney, if the Commission had received any funds for a Day Reporting Center. Mr. Chiles replied a formal letter had not been received on an amount.
Commissioner Cartmill stated there was a rumor that Cabell County had received money for a Day Reporting Center and that work was being done over at the old jail for the center.
W. Scott Bias, Commissioner, stated that with the expectation of receiving funds for a Day Reporting Center, he had discussed with Pete Meadows and Chris Tatum where a Day Reporting Center could be located and they were cleaning out some offices in the old jail.
LITIGATION
Nancy Cartmill, Commissioner, moved to go into Executive Session to discuss the litigation. W. Scott Bias, Commissioner, seconded the motion and the vote was unanimous.
The Commission recessed at 1:30 p.m.
Robert L. Bailey, President, reconvened the meeting at 2:35 p.m. with no action taken.
