Robert L. Bailey, President, stated that the Assessor’s Real, Personal and Business Property books were available for the board to review, if needed.

L. D. Egnor, Commissioner, moved to approve the letter to Cabell County property owners regarding the 10% increase of assessed values on reserved oil and gas.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

Burns stated that due to the location being in close proximity to Marcum Terrace and surrounding neighborhoods, he believed the appraisal should be $52,500.00.

 

After a brief discussion, L. D. Egnor, Commissioner, moved to reset Mr. Burns’ appointment to February 18, 2003, at 10:00 a.m.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

Mrs. Blaine Hatfield, citizen, appeared before the Board of Equalization and Review to request a reduction in the appraised value of their home.  Mrs. Hatfield stated the 2003 appraisal had increased their taxes more than one hundred dollars for this tax year.

 

Robert L. Bailey, President, informed Mr. & Mrs. Hatfield they would be notified by mail of the decision of the Board.

$100,000.00.  Mr. Ward further stated he had recommended a list price of $77,500.00 for the above property.

Lawrence Smith, West Virginia State Tax and Revenue office, also appeared and stated he would like to discuss the issue with Mr. Kell and return at a later time with his recommendation.

 

Commissioner Egnor offered his office for Mr. Smith and Mr. Kell to discuss the matter and asked that they return with their recommendation when finished.

Sharon Hodge, citizen, appeared before the Board of Equalization and Review to request relief on the appraised value of her home.  Ms. Hodge stated she had just purchased the property and believed there could be a mix up on the lots, as her escrow account had paid property taxes on a lot she did not own.

Upon returning, Commissioner Egnor informed the Board there was a problem with Ms. Hodge’s deed and they had spoken directly with her Attorney and the deed would be

corrected.  Brian Daniels, Deputy Assessor, stated Ms. Hodge was only appraised for the one lot on which her house was located.

Sharon Ross, Assistant County Manager, placed the teleconference call to Larry

Hamilton, Authorized Tax Representative for EBLS Property Management, who is the

manager for the East Hills Mall and the senior consultant for Marvin F. Poer & Company. 

 

Mr. Hamilton informed the Board he had calculated his figures based on an income approach. Mr. Hamilton further stated that there had been a drop in income due to a retail store moving out of the mall.

 

After a lengthy discussion, John Wheeler, Deputy Assessor, recommended decreasing the appraised value to $2,298,100.00.  Deputy Wheeler stated this would reflect a warehouse area instead of a retail area.

 

Robert L. Bailey, President, informed Mr. Hamilton he would receive the Board’s decision by mail.

 

After a brief discussion, L. D. Egnor, Commissioner, moved to decrease the appraised value of the property known as East Hills Mall, located at 5278 Irvin Road, Huntington/Guyandotte, Map 4P, Parcel 0124, Class 3, to $2,298,100.00.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

Kyle Ellis, citizen, appeared before the Board representing his mother who was the property owner, to request a reduction of the appraised value of property located on Mud River Road, Grant District, Map 25, Parcel 26, Class 3.  Mr. Ellis stated a right-of-way went directly through the center of the property and the property was located in the floodplain.

 

L. D. Egnor, Commissioner, requested Connie Gray, Administrator of Grants and Permits, provide the Board with information concerning the floodplain.

 

Robert L. Bailey, President, informed Mr. Ellis that he would receive the Board’s decision by mail.

 

After a brief discussion, L. D. Egnor, Commissioner, moved to reduce the appraised value of property owned by Mrs. Ellis and located on Mud River Road, Grant District, Map 25, Parcel 26, Class 3, to $36,000.00.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.

 

 

APPEARING:            DON HEBB, WEST VIRGINIA DEPARTMENT OF TAX AND REVENUE-PROPERTY TAX DIVISION

 

                                    RE: APPRAISED VALUE OF CERTAIN RESERVE NATURAL RESOURCE PROPERTIES

 

 

Don Hebb, West Virginia Department of Tax and Revenue-Property Tax Division, appeared before the Board to explain the reason for approximately 100 individuals receiving an increase for certain reserve natural resources on their property.  Mr.

Hebb explained that Cabell County was one of eleven counties to receive the new computer software for the mineral assessments and conversion of information for the computer system, several properties were not converted or were not included for mineral assessment.   Mr. Hebb went on to say the property owners involved had been notified and he would be speaking with any others who had questions regarding the mineral assessments.

CITIZEN TO SPEAK:

 

Howard Adkins, citizen, appeared before the Board of Equalization and Review seeking an explanation of the mineral assessment of his property, which was located on Big Cabell Creek.  Mr. Adkins stated he had been in contact with Mr. Hebb but was not sure if he needed to appear for clarification.

 

Mr. Hebb stated he had spoken with Mr. Adkins and the Assessor’s office and found that Mr. Adkins’ appraisement had an error in the timber acres and had been adjusted and corrected.

 

APPROVE:

 

L. D. Egnor, Commissioner, moved to approve evaluation corrections regarding letters sent February 6, 2003.  Nancy Cartmill, Commissioner, seconded the motion and the vote was unanimous.
