L. D. Egnor, President, called the special meeting of the Cabell County Commission to order at 10:00 a.m.
L. D. Egnor, President, stated the reason for the special meeting was to determine the necessity of the Commission to seek a declaratory judgment in Circuit Court regarding the recently enacted City of Huntington City Service Fee.
Robert L. Bailey, Commissioner, stated he had spoken with six council members and they were in favor of the county challenging the fee. Commissioner Bailey ask William T. Watson, County Attorney, to elaborate on his review of the service fee. Mr. Watson stated that upon review the service fee appeared to be closely related to the fee that had been challenged before.
Tom McCallister and Troy Hanshaw, Councilmen, appeared before the Commission to give their support and make sure the county had copies of the proposed service fee.
After a brief discussion, Robert L. Bailey, Commissioner, moved to approve William Watson, County Attorney, seeking a declaratory judgment in Circuit Court related to the enacted service fee by the City of Huntington. Earl “JR” Blankenship, Commissioner, seconded the motion and the vote was as follows:

L. D. Egnor, President, adjourned the meeting at 10:25 a.m., until the next regular scheduled meeting of June 27, 2002, at 10:00 a.m.
