At a Regular Session of the County Commission of Cabell County, West Virginia, held at the Courthouse thereof, on the 18th day of  November 2004, the following order was made and entered:

 

IN THE MATTER OF ADOPTING A PROPOSED AMENDMENT TO THE CABELL COUNTY COMMISSION’S ORDINANCE TO ESTABLISH, MAINTAIN

AND OPERATE A COUNTYWIDE ENHANCED EMERGENCY TELEPHONE

SYSTEM (E 911) AND FOR IMPOSITION OF A FEE UPON LOCAL EXCHANGE

SERVICE CONSUMERS TO FINANCE ITS INSTALLATION AND MAINTENANCE

 

The following resolution was offered by:

                        RESOLVED:  The County Commission of Cabell County,

                        West Virginia, having heretofore adopted an Ordinance for

                        the establishment, maintenance, and operation of a Countywide

                        Enhanced Emergency Telephone System (E 911) and desiring

                        to amend said Plan as hereinafter set forth, does hereby adopt

                        the following amendment to said Ordinance:

 

Page 8, Section 12 – Imposition of Fee (a), delete:  Pursuant to Section 7-1-3cc of the West Virginia Code, the Cabell County Commission shall impose a fee of $ 1.50 (Dollar & ˝), per month, per local exchange service line, except for Telassistance Service lines, to finance the projected costs of establishing, equipping, furnishing, and maintaining the Enhanced Emergency Telephone System.  Said fee shall be effective as of December 2, 1995.

 

Page 8, Section 12 – Imposition of Fee (a), add:  Pursuant to 7-1-3cc of the West Virginia Code, the Cabell County Commission shall impose a fee of Two Dollars and Fifty Cents ($2.50), per month, per local exchange service line, except for Telassistance Service lines, to finance the projected costs of establishing, equipping, furnishing, and maintaining the Enhanced Emergency Telephone System effective March 1, 2005.  Said fee to increase to Three Dollars and Fifty Cents ($3.50), per month, per local exchange service line effective July 1, 2009.  “Local exchange service line” shall mean a line provided by a local exchange provider pursuant to a local exchange service tariff, with the West Virginia Public Service Commission or otherwise for which said local exchange provider issues a bill to a customer or customers.  “Local exchange service line” shall include and be limited to the following:

 

1.            Each residence line

2.            Each business line

3.            Each semi-public and public telephone line

4.            Each PBX trunk

5.            CENTREX systems which shall be billed as follows:

§         Each of the first eight (8) lines of CENTREX will be billed the full monthly fee.

§         Each line thereafter will be billed at a rate of 1/8th of the full monthly fee.
